Transport Terms & Conditions

B Cole Son & Daughters Ltd

1. Definitions

"Company" refers to B Cole Son & Daughters Ltd.

"Customer" refers to any individual, company or organisation requesting transport services.

"Goods" refers to any caravan, lodge, machinery, vehicle, equipment or item being transported.

2. Quotations

All quotations are based on information supplied by the Customer at the time of enquiry.

Should dimensions, weight, access requirements, route restrictions or other details differ from those originally provided, B Cole Son & Daughters Ltd reserves the right to amend the quotation accordingly.

Quotations are valid for 30 days unless otherwise stated.

3. Customer Responsibilities

The Customer is responsible for ensuring:

  • All information supplied is accurate and complete.

  • Goods are fit for transportation.

  • Any required permissions, site access or authorisations have been obtained where applicable.

  • Access routes are suitable for transport vehicles and equipment.

  • The Goods are free from defects which may affect transportation.

Any delays, additional costs or damages resulting from inaccurate information may be chargeable to the Customer.

4. Transport Services

The Company will take all reasonable care when transporting Goods and will carry out services using suitably qualified personnel and appropriate equipment.

Estimated collection and delivery times are provided in good faith but cannot be guaranteed due to factors outside the Company's control.

5. Delays

The Company shall not be liable for delays caused by:

  • Traffic conditions

  • Road closures

  • Weather conditions

  • Vehicle breakdowns

  • Accidents

  • Permit delays

  • Escort vehicle availability

  • Circumstances beyond reasonable control

Where additional costs are incurred due to delays outside the Company's control, these may be chargeable.

6. Abnormal Loads & Specialist Transport

Certain loads may require:

  • Route surveys

  • Police notification

  • Movement orders

  • Escort vehicles

  • Local authority permissions

  • Additional equipment

Any associated costs will be advised to the Customer where applicable.

7. Collection & Delivery

The Customer or their authorised representative must be available at collection and delivery locations unless otherwise agreed.

The Company reserves the right to refuse collection or delivery where conditions are considered unsafe.

8. Cancellations

Cancellation charges may apply as follows:

  • More than 7 days before transport date - No charge

  • 3-7 days before transport date - Up to 25% of agreed transport cost

  • Less than 72 hours before transport date - Up to 50% of agreed transport cost

  • Less than 24 hours before transport date - Up to 100% of agreed transport cost

Where permits, escorts, accommodation or third-party costs have already been incurred, these costs remain payable.

9. Damage & Claims

Any damage or loss claim must be reported in writing within 48 hours of delivery.

The Company shall not be liable for:

  • Pre-existing defects

  • Mechanical failures

  • Hidden structural weaknesses

  • Wear and tear

  • Damage resulting from inadequate preparation of the Goods

Claims must be supported by evidence and photographs where possible.

10. Insurance

The Company maintains appropriate transport and public liability insurance.

Details of insurance cover can be provided upon request.

Customers are advised to maintain their own insurance cover for high-value Goods where appropriate.

11. Payment Terms

Unless otherwise agreed in writing:

  • Payment is due within the agreed payment period stated on the invoice.

  • Late payments may incur interest and recovery costs in accordance with applicable legislation.

  • The Company reserves the right to require payment in advance for certain services.

12. Force Majeure

The Company shall not be liable for failure or delay in performing services where such failure results from circumstances beyond its reasonable control.

13. Limitation of Liability

The Company's liability shall be limited to the extent permitted by law and subject to the terms of its insurance policies.

Under no circumstances shall the Company be liable for indirect or consequential losses, loss of profit, loss of business or loss of opportunity.

14. Governing Law

These Terms and Conditions shall be governed by the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
